I am not sure if this is a bug or not.
I decided to use the upsell feature in the product lines I recently updated.
After updating the products and generating the pages I noticed the following when I tested as a general user.
I selected one of the items and clicked the "Buy Now" option
I see the upsell item I have for the product, however decided to continue shopping without adding the upsell item to my cart.
I went to another item that does not have any upsell items clicked "Buy Now"
and then ... I see the upsell item for the initial product I added to my cart display.
Is this supposed to happen?

Yes, this is by design. You will not see that upsell screen if you have proceeded to the 1st checkout page and then continue shopping.
